Culture knows No Gender But Eunuch creating problem to public ??


Laxmi Narayan Tripathi, 32-year-old transgender activist is working at an alliance with the country's well known artistes to produce a show that has been ‘unimaginable' until now.
Not one to shy away from breaking traditions to make them more humane or forging new ties to make inclusive development a reality, Laxmi is in talks with senior Indian artists to organise the extravaganza.

A vocal advocate for equal rights for the transgender community, Laxmi says, “Of course it is a bold step forward to ascertain our identity. The idea of this cultural programme is to bring to the forefront the co-existence of the hizra community in our society, to give a face to this section of people who are often more talked about than talked for,'' said Laxmi.
“Though the details of the scale, scope and reach of the programme are yet to be worked out, we hope that such an assertion of our right to live a life of dignity will help our larger cause,'' added Laxmi who is no stranger to challenges. She was one of the first to go public with her ‘story' and has devoted herself to the welfare of the transgender community for over a decade now.

She was a member of the United Nations Civil Society Task Force on HIV/AIDS in 2008 and is a founding member of the Asia Pacific Transgendered Network; and chairperson of Astitiva a non-government organisation involved in working for welfare of transgender community.



Laxmi who most recently participated in the popular reality show Big Boss “to highlight and sensitise the general public about the fact that transgender are normal human beings'', has also participated in other reality shows including ‘Sach Ka Saamna' and ‘Raaz Pichle Janam Ka.'

“Reaching out to the general public through television is important. Putting a face to the transgender community I think allows people to react with more humanity. After seeing me on Big Boss I think a lot of people now understand that behind all the talk and makeup we are nothing more than just regular people,'' says Laxmi.

Stating that the transgender community is a group of very visible people who are deliberately and conveniently kept invisible by society, Laxmi says: ``This is the most hurtful fact of our life that we live with every second. Imagine being ridiculed, abused, and rejected by society over and over. Imagine the fear that accompanies us through every thought, action and desire and then imagine the desperation of this all.''

“Our gender ensures that we are usually kept away from schools, colleges, social gatherings, religious functions, the election process or even having a say in Government policies made for our welfare. Every day my basic constitutional rights are taken away and no one gets punished for it. The society has learned to use and throw us. Though several policies and people claim that they accept us, it does not truly reflect in spirit,'' points out Laxmi.



“A good example of this discrimination is our medical health system. We have almost no access to quality drugs. Allocation of funds to help us is practically non existent and worse there is no political will to bring about any positive change. Raising these issues with the Government is next on our agenda. We not only want a normal life of dignity, we also want to live with the rights that the Constitution of India guarantees to us as citizens, because we are that first, our gender comes later,'' states Laxmi.


“And this cultural extravaganza is a step in that direction to make people realise that music, dance, drama, poetry is also our way of expressing our joys, sorrows, desires, dreams and ambitions. We hope that through this venture we are able build bridges and form some lasting friendships,'' adds Laxmi.

The country may see the first-of-its-kind transgender cultural extravaganza this year.

The Samta Nagar police are planning to ask Interpol to issue a red corner notice against a Kandivali resident for allegedly assaulting and cheating his wife.
The police had issued an arrest warrant against Avdoot Sawant, a human resource manager in a firm in Nigeria, after his wife registered a complaint alleging her husband married her in spite of being a homosexual.


According to Senior Inspector of Samta Nagar police, Anant Kenjle, a complaint was filed against Sawant after his wife found out that he was gay. Kenjle said the couple got married in December 2010 and stayed together in Lokhandwala Complex in Kandivali (East) for a couple of days, before Sawant left for Nigeria. When he came back, the couple went on a honeymoon.


In April this year, Sawant’s wife decided to pay him a surprise visit in Nigeria. “When she reached there, she found out that her husband was gay while browsing his laptop, which contained certain objectionable videos and recordings. When she confronted Sawant, he allegedly beat her up. She then returned to India and approached the police,” said Kenjle.

INDORE:   In lack of a separate cell for the eunuchs, jail staff are confused whether Pinkibai and Durgabai, who along with four others were punished with life imprisonment by the district court on Wednesday, should be kept with male or female prisoners.
A jail official on the condition of anonymity said, "Eunuch are likely to get sexually assaulted if kept with the male prisoners. If kept in the cell reserved for women, other prisoners may not feel comfortable."

District jail superintendent Dinesh Nargawe said, "We have decided to keep eunuchs Pinkibai and Durgabai in a separate enclosure in women cell temporarily.
Soon, they will be shifted to the central jail." After that, onus will be on the Indore Central Jail authorities to decide where these prisoners will be kept."


When contacted, Central Jail in-charge R C Arya said that in case of eunuchs, they generally decide on cell by the kind of dress worn by prisoners. He recalled an incident where a eunuch who was dressing up like a man, was kept in the male's section, but in an isolated cell.
Pinkibai and Durgabai, along with four others, were punished with life imprisonment by the district court on Wednesday. They were found guilty for the murder of another eunuch, Mohini (30) on March 16, 2009 at her home in Nandlalpura area. Another eunuch Payal had sustained serious injuries during the attack.
Punjab jail authorities had faced a similar situation in 2010. They were confused over the sexual identity of transgender Sudhesh Kumar alias Baba. Sudhesh was shifted to Ludhiana in April 2010, a month after he was lodged in Patiala Central Jail following his conviction in an attempt to murder case by a Derabassi court.

Patiala jail officials then claimed that he was found without a male organ in the medical examination conducted by jail doctors. He was shifted to Ludhiana Central Jail and lodged with women inmates there.

However, when Sudhesh insisted on a re-examination, tests established the absence of uterus and ovaries. Later, it was stated that since the prisoner did not have uterus and ovaries, he should be deemed a male transgender. The eunuch had returned to Patiala jail, but the officials had to struggle hard to decide on his lodgings.

What is it that they have, which we don’t, that makes them behave in a manner, in which we can’t?
Or is it because they don’t have some thing which we have, that makes them behave in the manner they do.
Did you say I am hitting below the belt? Don’t worry, in their case it hurts only metaphorically!
Almost all eunuchs are castrated males.

We had been made to believe that a person’s behaviour is governed by his brain, mostly located at the top of his head inside the skull. While we also knew that human bodies are samples of complex circuitry, we never knew the circuitry was so complex and cross-linked — that a person’s behaviour could be so affected by ball-tampering. And we are not talking cricket and Darryl here! (Did you notice, this was an instance of here/Hair inter-operability)
Coming back to the subjects, who are also subjects of further implants and other forms of surgical pyrotechnics…

We see them everywhere — forcibly getting into our homes to pique our happier moments; haranguing us at traffic signals; man-handling us in trains. Reminds me of the time when eunuchs would board the Indore-Delhi trains at Ujjain and pinch the facial cheeks (pardon my having to specify facial!) of my IIM Indore batch mates, calling them ‘Aye chiknay!’ or ‘Aye Shahrukh!’ Luckily, because of my beard, I had to settle for ‘Aye Prem Chopra!’ instead. Trust me this was THE situation in life where being called a Prem Chopra was much better than being a called a Shah Rukh and getting googly-woogly-wooshed by eunuchs!

Mark my words — it is just a matter of time before they start walking up and down the aisles of aircrafts asking people to pay up! After all what’s the big deal in investing a couple of thousand rupees in an airline ticket to get captive victims for a few hours, from whom they can make much more! (150 passengers x Rs 100 per person = Rs. 15,000!) And for those who complain of boredom in flights, these people will also sing and dance!

A few months ago, when this cousin of mine shifted to his new flat in Ghaziabad, many of us (kith and kin) turned up for the griha pravesh at the new flat. Things (lunch and socializing) were going on fine, till they arrived; in a Maruti van. (Their intelligence gathering is so precise — sometimes I wonder why aren’t they employed as postmen/policemen, err… post-whatever/police-whatever!) Since the doors were open they had no problems praveshing the griha! And in case you didn’t know — once inside, they are impossible to dislodge, unless you are oh-so-willing to readily part with some thousands of rupees of your hard-earned money!
Different people in the gathering tried different ways to reason out with them.

This is a person.
If it sounds like we’re being vague here (Africa is a big, big place), it’s because the details surrounding this video are hard to come by. One thing everyone agrees on however is that the victim in this video is gay. Several media outlets are claiming this nightmare went down in Uganda, but again, we’ve seen no evidence locking down a location or even a name for this poor man.
Real talk, this is the most graphic and shocking example of violence we’ve ever seen in our lives. This video is not for the faint of heart. Hell, it’s not even for most human beings. We honestly argued with one another here in the UB office over who had to cover it, because none of us could even stand to make it all the way through the video.
A gay man is beaten to a bloody pulp by an angry mob in this video, doused with some sort of flammable liquid, buried under a pile of wooden rubble, and then set ablaze. You will cry. You will want to throw up. You won’t make it through the video.
It’s graphic and disgusting and the saddest thing we’ve ever seen. But this man was reportedly one of us, and nobody even seems to know his name. How could a man be turned into his own funeral pyre by dozens of hateful attackers somewhere in our world without anybody even knowing where it all went down?
No matter who he was, or why he was subjected to this torture, this mystery absolutely must be solved. And those responsible must be brought to justice. And if it does in fact turn out that this killing occurred in a nation that criminalizes homosexuality and allows murder to go unpunished, then this harrowing result of that political and cultural climate must be shared with the world to shame that country into changing their ways.

***Update: Unable to speak Nigerian myself, I have no way of vetting what is being said in this video. Hell, I’m not even sure it’s Nigerian that’s being spoken. We posted this video because it was sent to us from three different sources that stated this was an attack on a gay man. Since sharing, we’ve faced criticism that this story isn’t relevant to the LGBT community because the man in the video may have been beaten to death and set on fire for being a thief, and not for being gay. How that in any way justifies burning him to death in front of a crowd is beyond me.
If you’re the type of person that is angry with me for reporting a man was burned to death, but thinks it’s OK because he wasn’t gay – then you’re not the type of person I care to cater to in any way at all and you can keep on moving right along with your shameful self. The world where people aren’t burned alive that you’re pretending to live in is really just that one click away. Peace.

OIG Releases Report on Investigation of Funds Managed by an SR in India
Claims that at least $872,000 was misappropriated


On 31 October 2011, the Global Fund's Office of the Inspector General (OIG) released the final report of an investigation into a portion of two HIV grants to India. The investigation, which was launched in February 2011, concerned $1.28 million transferred by a sub-recipient (SR), the India Network for People Living with HIV/AIDS (INP+) to the Positive Support Fund (PSF). The principal recipient (PR) for the two grants was the Population Foundation of India (PFI). The HIV grants were from Rounds 4 and 6.

The OIG said that it found credible and substantive evidence that $872,000 was misappropriated and should be returned to the Global Fund, and that the amount misappropriated could be as much as the full $1.28 million transferred to PSF.

According to the OIG, grant funds were transferred to a shell corporation, PSF, controlled by a principal of INP+, Mr. K.K. Abraham, and some of the funds were used for purposes personal to him.

The OIG said that there is substantive and credible evidence that Abraham purposefully took advantage of his position, first as President and then as General Secretary of INP+, to engineer transfers of grant resources to PSF, an organisation which he controlled as its President and a lifelong Board Member, and for which he was the primary signatory on the organisation's bank accounts.

The OIG said that Abraham was a driving force behind creating PSF, served as its most senior officer, and made the significant and substantive decisions in both PSF and INP+, including how funds were to be expended. "These facts and circumstances created a conflict of interest, and were in breach of the terms of the grant agreement."
The OIG said that it found various other forms of what it called "fraud, abuse and mismanagement" within INP+ and PSF. For example:

• the leadership of INP+ concealed and misrepresented its contributions to PSF;

• PSF paid for utilities, rent and other costs related to an apartment owned and occupied by Abraham and an associate;

• compensation paid to certain staff members was under-reported to the Global Fund; and

• PSF provided few services since its inception.
The OIG said that it found evidence that INP+ retaliated against whistle-blowers and other critics of PSF by disaffiliating two state-level networks and removing a board member from office after they raised concerns about the function and funding of PSF.

Finally, the OIG found that the PR, the Population Foundation of India (PFI), failed to fulfil its oversight responsibilities with respect to INP+, and did not act "with energy and enthusiasm" to make appropriate changes and obtain recoveries of lost sums once the problem was identified. The OIG said that despite multiple requests, PFI did not bring about the necessary change in INP+ management, did not exercise proper control and fiduciary oversight of this SR, and failed to require misappropriated grant funds to be returned.

The OIG recommended that the Global Fund immediately seek to recover all outstanding losses - i.e., at least $872,000 - and that grant funds that are still in accounts owned or controlled by PSF's leadership be immediately returned to the Fund.

The OIG also recommended that the Global Fund require the PR, PFI, to make any future cooperation with INP+ subject to certain conditions - including that INP+ reimburse the losses, and remove Abraham from his position and bar him from any activity related to Global Fund grants.

In its report, the OIG said that it was first notified of allegations of financial mismanagement within INP+ in March 2010, and that at the request of the CCM and the Global Fund Secretariat, it deferred launching an investigation pending an independent review of INP+ by an audit firm selected by the CCM. (The audit firm was KPMG.)

According to the OIG, the KPMG review confirmed that INP+ violated the relevant grant and sub-grant agreements by transferring grant funds to a closely affiliated organisation, PSF, which failed to use these monies for programme-related purposes. However, the OIG said, because the KPMG review lacked a forensics component, it was not able to determine the full amount of loss to the Global Fund, and to identify all of the parties responsible for the loss.

The OIG said that KPMG submitted its final report to the CCM and the Global Fund in October 2010, but that neither the PR, PFI, nor the CCM required the misappropriated funds to be repatriated by PSF, and that the individual responsible for the misappropriation remained in senior positions in both organisations, INP+ and PSF.

The total value of the two grants, which were eventually consolidated into one grant, was $45.0 million, The total value of the contracts with INP+, as SR, for the period 2005-2010, was $15.8 million.
Reaction and follow-up

INP+
The audit report contains extensive comments from INP+ on the investigation's findings. INP+ implied that some money was transferred from INP+ to PSF, but categorically denied that any Global Fund money had been transferred to PSF, and said that its grant "has not been used for any purpose outside its broad core activities." INP+ also said that the process of the investigation was flawed, discriminatory and biased, and that the Global Fund was not authorised to investigate PSF because PSF has never received any grant from the Fund.

With respect to the allegation that the INP+ retaliated against whistle-blowers, INP+ said that "the purported whistle-blower has an agenda and an axe to grind" and had been involved in many "criminal cases." The full set of comments from INP+ can be found on pages 68-86 of the OIG's report.

In response, the OIG said that INP+ had failed to address the evidence that INP+ transferred Global Fund grant funds to PSF; and that the assertion by INP+ that all Global Fund grant monies were used for programme-related activities was "contrary to evidence." The OIG's response to the comments from INP+ can be found in paragraphs 135-143 of the report (there are no page numbers in this section of the report).

Concerning the allegation that PSF paid for utilities, rent and other costs related to an apartment owned and occupied by Abraham and an associate, Abraham told GFO when we were preparing this article that this apartment served as a registered office of PSF.

Abraham also told GFO that it considers the OIG report to be "illegal," and that the OIG acted simultaneously as accuser, investigator and judge.

On 21 November 2011, INP+ President Jahnabi Goswami sent an email to Simon Bland, Chair of the Global Fund Board. GFO has obtained a copy of the email. Goswami said that the money which the OIG categorised as "losses" came from the 8% fee for overhead and management expenses related to the funds INP+ was managing as SR, and that this money was "managed carefully" and vested with a subsidiary of INP+ [presumably, PSF]. Goswami told Bland,

"It is a sad day for the fight against HIV/AIDs in India that INP+, the oldest and largest network of PLHA in India, is returning money to the Global Fund. We do so under duress, with a loud protest, since this money was neither lost nor misappropriated, but sitting in plain sight, unutilized pending clarity from the Global Fund on valid use of overhead/ management expenses that were not expended but saved. We feel penalized for having saved money, an odd situation by any imagination."

PFI and the CCM
The investigation report also contains comments from the PR, PFI, and the CCM. Neither set of comments dealt with the substance of the OIG's findings concerning INP+.

However, the CCM took issue with the OIG's statement that the CCM had asked the OIG to defer its investigation while the investigation conducted by KPMG was underway.

Further, the CCM objected to the inclusion in the audit report of the statement by the OIG that the CCM failed to act to require PSF to return the misappropriated funds because, the CCM said, the CCM is not a legal entity and so does not have the legal authority to recover funds.

Finally, the CCM expressed frustration with the way the OIG handled the situation with KMPG and the CCM.

When we were preparing this article, PFI told GFO that, on 12 October 2011, PFI sent substantive comments to the OIG on the draft OIG report, but that the OIG chose to include only an annex to PFI's comments in the final investigation report.

PFI said that the OIG report contains "assumptions and misconceptions rather than credible and substantive evidence."

Concerning the OIG's comment that PFI failed to act with "energy and enthusiasm," PFI said that it had responded promptly and positively to all requests from the Global Fund.

PFI said that upon learning that INP+ had transferred funds to PSF, PFI immediately arranged for an audit to be conducted. When the audit confirmed that some transfers had occurred, PFI said, it immediately wrote to INP+ insisting that the transfers be reversed.

PFI said that as a result of its persistence, some of the money was retrieved from PSF. PFI said that when it tried to arrange for a second, more detailed audit in January 2011, the OIG "stopped PFI from doing so," because the OIG was about to start its own investigation.

In the comments that it sent to the OIG on 12 October 2011, PFI said that it rejects many of the conclusions of the investigation report and "any liability to reimburse any program monies." PFI said that it had not violated any of the conditions of the grant agreement.

Global Fund Secretariat
The investigation report reproduced a letter dated 10 October 2011 from Mark Eldon-Edington, Director of Country Programs for the Global Fund, in which Edington said that the Secretariat "fully supported" the findings of the investigation and would undertake "strong action" to recover the losses.

Edington said that Abraham had not fully recused himself from matters relating to programmes supported by the Global Fund, and that this had heightened the Secretariat's concerns about the ability of INP+ "to take the corrective actions necessary to enable it to implement a Global Fund-supported grant." Edington said that the Secretariat has therefore not authorised PFI to enter into a new agreement with INP+. (The previous agreement with INP+ lapsed in 2010.) Abraham told GFO that he had recused himself from matters related to the Global Fund grants, but that he had not recused himself from INP+.

In his letter, Edington outlined a series of measures that the Secretariat is implementing. These measures are described on pages 91-93 of the report.

Party names transgender as CM candidate, to field 50 eunuchs

Lucknow : There is nothing new in transgenders fighting elections these days but in a first, a political party has now decided to field 50 candidates from this marginalised and stigmatised community in the upcoming assembly polls in Uttar Pradesh. Not only this, the little-known Rashtriya Viklang Party (RVP) has projected an eunuch as the chief ministerial candidate. "The party has decided to field at least 50 eunuchs from different assembly seats and five names have already been announced," party's national general secretary and UP incharge Virendra Kumar said. He said that national president of Kinnar Morcha Shobha Bua has been named candidate for Dhaulana assembly seat in Ghaziabad. "Shobha Bua will also be chief ministerial candidate of the party," he added. Kumar said that the first eunuch MLA of the country Shabnam Mausi, who won election from Suhagpur seat in Madhya Pradesh in 2000, would be party candidate from Kanpur cantt seat. "People have lost faith in the political parties and they are looking for good candidates. Though eunuchs are a marginalised section of the society, but their honesty and ability cannot be ignored and the party will move with issue," he said. The state in charge claimed that their initiative was attracting support not only from various organisations of eunuchs and people working with them, but also from the masses. He said that the situation has changed after victory of their candidate Kamla Bua as mayor of Sagar in MP in 2009 and entry of Shabnam Mausi in UP and it would reflect in UP polls as well. "People are fed up with corruption and are ready to vote by rising above the gender difference," he said. "In our election manifesto, various issues related to eunuchs, including reservation in accordance with population, pension to eunuchs above 40 years like Delhi Municipal Corporation, right to live like a common citizen and their rehabilitation will be included," Kumar said. He said that while leaders of other political parties have their own interests, it was not the case with the eunuchs. "They neither have children, nor families, therefore they have no reason to indulge in corruption," he said. Pune YCMOU’s course for transgenders hits roadblock ?

The proposed course on basic literacy for transgender community by Yashwantrao Chavan Maharashtra Open University (YCMOU) seems to have hit a roadblock as the community itself feels ‘too debased’ for any redemption.



YCMOU vice chancellor, R Krishnakumar, told DNA that despite several meetings arranged through NGOs between varsity officials and third-sex community leaders, the course hasn’t started due to problems in understanding the aspirations of the target audience.
The course, said Krishnakumar, is a small step by the university in bringing the marginalised sections of society like transgenders and sex workers into mainstream.
“We wanted to do something for this community whose rights are trampled in every step of life. They are not given a chance to become a part of mainstream and we thought education can help alleviate their present condition,” said Krishnakumar.
However, several meetings with community representatives in the last three months were unproductive.
“Nothing conclusive evolved out of these meetings. This is because they don’t have the confidence that anything we do might help them. It is unfortunate, but we are determined to make this work and will continue to meet them. We are serious about the course for transgenders,” he added.
Another problem that the university is facing is to convince their own staffers to do voluntary work for the community.
“The staffers are not going to be paid or applauded for their efforts; this work is mainly for their own sense of duty towards society. Our staffers had apprehensions but we have managed some amount of success and that roadblock is crossed,” he said.
The courses were meant to teach the transgenders basic concepts of arithmetic, communication and alphabet. The short-term certificate courses would mainly be vocational in nature and focus on managerial skills, which will help students to set up small manufacturing units.

He accepted that he does prefer men and there is nothing to be ashamed of as it comes naturally to all human beings. The 51-year-old  actor bluntly accepted that he developed such feelings against the same gender later at an age many years after of his successful marriage and filmi career.

Jackie Sheroff added that during the era of 80s and 90s he never felt such a way and was highly intimated by the leading ladies he worked with, and he respects each and everyone of them as they all helped him to be a better man.  In an emotional conversation, he concluded that he is leaving his family and moving abroad as he does not have enough faith in homosexuals rights in India and he might have to face allot of problems continue living here.
Jackie was born in the marathi-speaking Shroff family on February 1, 1960. His brother’s name is Hemant, and they live in Bandra, Mumbai. He is a vegetarian.
He married his longtime girlfriend, Ayesha Dutt, who is a producer. Both husband and wife run Jackie Shroff Entertainment Limited. They have two children: a son, Jai, and a daughter, Krishna.

“I want to personally find that person and beat him up. From where did they get this piece of information? Anybody who knows me wouldn’t think like this in their wildest dreams,” said Jackie in-between his shots.
According to Jackie, he doesn’t remember speaking to anybody about his sexual preferences. “People say whatever comes to their minds. I haven’t spoken like this to anybody. I don’t know from where they got this information. Imust have spoken about my adulation for a few male actors, but I don’t think I ever meant something like that in a sexual way. In fact, I don’t even recollect which conversation these guys are referring to,” Jackie adds.


When Jackie was asked about his upcoming film needing some publicity, he feigned ignorance about it. “Could you tell me which film is releasing? (On being told the name of the film) Is it? But I am told that it is a regional Telugu film. So are they dubbing that in Hindi now? I am in Mysore shooting for my film and I don’t have the faintest idea of all this. Can you please ask the producers if they have any idea about it,” the actor says.
No talk about the film was needed, after all, it got spoken about enough on the social networking sites already.

New Delhi: The news of Jackie Shroff being a gay spread like wildfire so much so that the actor had to actually come out and clarify the issue. The actor has rubbished the reports of him being a gay.
Jackie Shroff has expressed his anger over the matter and has talked to The Times of India about the issue. He said,"Bhidu, I'm not gay! Kaam dhanda nahin hai logon ko... kalyug jhelo (People have no work... it's the times we live in)!"
